Esprit faces statutory demand for nearly $4 million over ICC arbitration loss
Esprit received a statutory demand for nearly US$4 million on September 18, 2026, over its loss in an ICC International Court of Arbitration case concerning the 2024 collapse of its European operations. If the amount is not paid within three weeks, the law firm owed the money may file a winding-up petition in Hong Kong.
The demand comprises US$3,992,648.83 and HKD$41,656.36, the latter equivalent to about US$5,200, for legal services the firm says it provided but was not fully paid for. Esprit reported half-year revenue of just US$1.9 million for the period ending June 30, 2026, while noting it remained solvent due to a $42.7 million loan facility. Of that facility, the company has drawn only $16 million to date, leaving the majority undrawn. Esprit had previously disclosed its intention to move away from manufacturing and retail toward a brand-licensing model focused on acquiring and selling trademarks.
“The company is currently evaluating the potential impact on the operation and financial position of the company,” it continued before cryptically noting it “remains open to discussions with the [legal] firm with a view to reaching an amicable resolution,” Esprit, in a stock exchange filing on Thursday said.
“By shifting away from its legacy business model and capital-intensive infrastructure, historically burdened by significant expenditures in sourcing, distribution and retail operations, the company is now moving towards an asset-light, licensing-centric business model,” Esprit, in an August results announcement said.
Esprit had disclosed the liability in its half-year results released last month, and in its August results announcement expressed confidence in its future after shifting from manufacturing and retail to a brand-licensing model aimed at acquiring and selling trademarks.
